Arnab Goswami’s arrest in suicide case illegal, court observation – India news

The Chief Judicial Magistrate court has observed that the arrest of Arnab Goswami and two others seemed illegal in connection with the suicide of 53-year-old interior designer Anvay Naik and his mother Kumud Naik, while rejecting the prosecution’s plea for questioning in his custody gave. .

In May 2018, almost a year after Republic TV launched, Naik and his mother were found dead at their farmhouse in Kavir village in Alibaug taluka.

The complaint was then filed by 48-year-old Naik’s wife Akshata. A suicide note was found, police said, in which Naik alleged that he and his mother were forced to end their lives as they had not been paid the dues of Rs 5.40 crore by Goswami, Sheikh and Sarada.

Alibaug police on Wednesday arrested Feroz Sheikh, editor-in-chief of Republic TV, IcastX / Skimedia owner and Smartworks owner Nitesh Sarada. The prosecution sought maximum custody of them for further investigation. Chief Judicial Magistrate, Alibaug, Raigad – Sunayna S. Pingle dismissed the petition.

In his order, the judge stated, “In view of the objections raised by the defense lawyers and the charges raised by the prosecution seeking police custody, the arrest itself is illegal. After careful examination of the document it appears that the relationship between the incident that occurred at that time, the death of two persons, the relationship between the deceased and their relationship with the accused should have been determined before seeking police custody. If this sequence of circumstances remains, the incident’s relationship with the accused can be established to seek police custody of the accused. ”

The magistrate court raised serious questions on the principle of Naik’s mother’s suicide. The court questioned that there is no reason for Naik’s mother’s death if the prosecution case is to be considered true.

“Even though it is believed that the accused had to pay money to the deceased Anvay Naik and other contractors were harassing him for payment, he was depressed, the question is why his mother Kumud Naik decided to end her life.” The The prosecution has no satisfactory answer on the issue. The series of circumstances, between the death of Kumud and Anvay Naik, the cause of his death and its relationship with the accused is not fully established, ”reads the order in Marathi.

The court also questioned the decision of further investigation. The court said that the prosecution has not come forward on the basis of why the previous investigation is incomplete and what are the issues for further investigation.

There is no prima factory of circumstances to link the accused to the incident to send the accused to police custody. The police therefore closed the case for evidence. The said closure report has not been challenged by any High Court nor is it still in existence. In such circumstances, there is no proper basis for sending the accused to police custody, ”reads the court order.
