Bengaluru: Knowledgeable And its former employee Debi Mishra has reached a class-action settlement agreement, where it has previously agreed to pay $ 5.7 million to pay for underpaste overtime.
Mishra and other employees who were part of the class-action, worked in the Quality Engineering and Assurance (QE&A) team. Mishra worked on the team for Cognizant’s client Blue Shield in California until he resigned in 2015. In the lawsuit, Mishra alleged that Cognizant did not make the premature payment due to its failure to include certain amounts when paying dues. The TOI contains a copy of the court document. Emails sent to Cognizant did not respond.
Mishra alleged that in 2012, he received a letter stating that the terms and conditions of his employment had changed. Cognizant informs him that his “status is classified as overtime eligible.” The letter also indicated that Mishra was guaranteed to earn “no less than $ 62,100”, and bonuses would be added to keep his annual income at this level. But the actual payments were described as too low. Mishra’s lawyer retained an expert forensic economist to review and analyze the data. As calculated by forensic economists, the total potential loss for all employees involved was $ 11,219,891. Cognizant rejected this analysis, stating that Mishra and class members “did not actually work overtime hours and instead only recorded overtime as a means of obtaining faster and more evenly spread pay” . ”
Mishra filed the original complaint on August 25, 2017. Nearly a year later, the parties attended a full day of private arbitration before the retired judge but did not reach a resolution. The latest settlement agreement by the US court requires the cognizant to pay an estimated half as damages by the plaintiff. Most of this amount will be divided among the members of the class.
