New Delhi: The National Green Tribunal has asked the UP Pollution Control Board to remodel its Environmental Restoration Fund within two months.
It added that the fund should be spent on strengthening vigilance mechanisms, setting up laboratories, monitoring the environment, hiring experts and consultants, removing contaminated sites and conducting studies.
A bench headed by NGT Chairperson Justice Adarsh ​​Kumar Goel said that the Environmental Restoration Fund should be spent as per the plan to be approved by the National Campa Advisory Council (NCAC) and not for government functions.
“We instruct the state pollution control board to reissue its plan. The Central Pollution Control Board may oversee the preparation of such an action plan. Chairman and Member- The Secretary may have a meeting (physical or online) with the Chairman and Member Secretary of the State PCB within a month. The bench said that the plan could be finalized with the approval of CPCB within two months.
All other state pollution control boards in coordination with CPCB can prepare similar action plans for the restoration of the environment and the implementation of district environmental plans.
The bench said that the CPCB can also prepare such a scheme for the use of the funds available with it. The CPCB can file a compliance report to this effect by e-mail within four months.
The tribunal was hearing a petition filed by UP resident Ashish Kumar Dixit, who acted against illegal operation of marriage halls, nursing homes, clinics, hospitals, commercial premises, hotels and other business establishments without prior consent from Banda, Mahoba and UPBB.
