A Pakistani court has ruled in an extraordinary case that the practice of subjecting a girl to a virginity test is illegal.

The Lahore High Court on Monday ruled that virginity has no legal basis and “violates the personal dignity of the victim”.

Delivering the verdict, Justice Ayesha Malik said: “The examination of virginity is very offensive, which has no scientific or medical need, yet in cases of sexual violence, it is done in the name of medical protocol.

“It’s a humiliating practice, used to cast doubt on the victims, as opposed to focusing on the accused and the incident of sexual violence.”

She said the decision was the culmination of a history of activism and was based on a struggle that has been going on for decades. The experiment is part of a larger teacher structure that persecutes female characters and creates the story of the ‘perfect victim’.

“The barriers to reporting rape to women are unacceptable, but this historic decision will go a long way in removing those barriers,” she said.

Police and prosecutors have used the findings to accuse abusers of having illicit sex and committing crimes with them.
