He also called Trump’s call in an August 6 executive order for a tricotoc ban to advance his alleged “sweeping campaign of anti-China rhetoric” ahead of the Aug. 3 US presidential election, where Trump is seeking a second term .
“We do not sue the government lightly,” Tikotok said in a blog post. “But with the executive order threatening to ban our American campaigns … we simply have no choice.”
The White House sent a request for comment to the US Department of Justice, to which there was no immediate response.
TikTok and ByteDance are seeking a permanent injunction preventing Trump from enforcing their August 6 order.
The lawsuit filed in Los Angeles federal court named Trump, the US Department of Commerce and Commerce Secretary Wilbur Ross as defendants.
Amid growing mistrust between Washington and Beijing, Trump had complained for weeks that Tiktuk is a national security threat that could share information about users with the Chinese government.
His August 6 executive order called for a ban on transactions with the app after 45 days.
Trump issued a separate executive order to BiteDance on August 14 to split Trump’s US operations and any data Tiktok had gathered in the United States.
Reuters reported last week that Tiktok was preparing a legal challenge.
Bytdance acquired Shanghai-based video app musical.ly in a $ 1 billion transaction in 2017 and relaunched it the next year as TikTok.
Tiktok said the Trump administration violated its constitutional right by banning the company without notice.
It accused Trump of abusing the International Emergency Economic Powers Act, which allows the president to regulate international commerce during a national emergency.
Trump enacted that law in May 2019 to block alleged attempts by foreign telecommunications companies to carry out economic and industrial espionage against the United States.
The Trump administration has said that Americans should use caution in using Tickcock. Under a law introduced in 2017 under President Xi Jinping, Chinese companies have an obligation to support and cooperate in China’s national intelligence operations.
But Tiktok said Trump’s August 6 was not rooted in genuine national security concerns or backed by a declared emergency a year earlier.
It called the order “the gross misconception of the IEEPA authority and the pretext to carry on the president’s extensive campaign of anti-China rhetoric in the US election.”
Bytadnes is in talks to sell TeakTalk’s North American, Australian and New Zealand operations to companies including Microsoft Corp and Oracle Corp.
Those assets can range from $ 25 billion to $ 30 billion, according to people familiar with the matter.
Prior to purchasing TikTok, Bytdans did not seek advance approval from the Committee on Foreign Investment in the United States, which reviews the acquisition for potential national security risks.
CFIUS subsequently opened an investigation, and according to TikTok “repeatedly declined” before saying it had seen the national security risks associated with the purchase.
